Use of equipment and warranty limitations

Please note that Applied Practical Technology is a value-added operation only, guarantees its own services and work done on behalf of the client to the extent of repair, replacement, or rework for a period of 30 days from the date the work is done or service performed. APT manufactures no equipment and is NOT RESPONSIBLE OR LIABLE for the functionality of photocopiers, printers, and/or any computing devices or any other devices with which APT-supplied ITC Systems' or other equipment and for which all other APT services are used. APT specifically is NOT LIABLE regarding direct or indirect consequential damage or losses of business, profit, use, incurred by APT's clients, their customers and/or any third party with respect to the use of APT's services or APT-supplied equipment. This disclaimer covers equipment connected to hardware interfaces, coin controllers, and ITC Systems' card readers and keypads, and any equipment using ITC Systems' printing control software. Warranties for any ITC Systems' equipment and all other services and equipment supplied by APT are the respective Manufacturers' own warranties. APT in no case assumes or alters the manufacturer's warranties provided by ITC Systems or other suppliers who are the sources of APT-supplied equipment and/or services. Submitting a purchase order or other requests related to the services and/or equipment supplied by APT constitutes acceptance of the above conditions and the terms of Liability set out below. This document states the responsibilities offered by APT for any products or services APT provides to its clients. APT shall not be liable for any direct, indirect and/or consequential damages or losses, including loss of use, revenue, profit incurred by the client, its customers and/or any third party as a result of the use of the work carried out by APT for the client, including any loss resulting from equipment failure or malfunctions, manufacturer’s design or programming errors or any other use of the work carried out. The client specifically waives any claim or recourse it may have against APT in any of the above instances. APT acts in accordance with, but does not assume or alter in any way the equipment Manufacturer’s warranty for all parts of new equipment purchased through APT, from date of invoice or installation (whichever is earlier). DEFECTIVE MATERIAL OR WORKMANSHIP is covered to the extent of repair or replacement. Damage caused by accident, abuse, faulty installation, client-supplied electrical power, static electricity, environmental conditions, or improper operation are excluded. APT will repair, or at its option, replace without charge, F.O.B. Burnaby, B.C., defective parts on equipment purchased through APT and returned to APT in accordance with the original manufacturer's warranty conditions. APT's obligation is limited to repair or replacement as stated herein. Any changes in design or improvements added to the line of equipment shall not create any obligation to install same on equipment previously sold and delivered to the client. Any unauthorized alteration of, or addition to, equipment purchased through APT voids all warranties. Equipment returned for Warranty repair must be accompanied by a copy of the Bill of Sale as verification of Purchase date. Equipment repair costs for equipment returned without a Bill of Sale, or out of its manufacturers warranty time, or not purchased through APT will be charged to the client at the normal repair rates.
